A German court ruled in favor of the country’s music rights society, GEMA, on Tuesday in a major copyright case against the U.S. artificial intelligence company OpenAI.

The court in Munich decided that OpenAI could not use song lyrics without a proper license. The presiding judge, Elke Schwager, also ordered the company to pay damages for its use of copyrighted material.

GEMA had sued OpenAI, arguing that its popular chatbot, ChatGPT, was reproducing lyrics from copyrighted German songs without permission. The music rights society also claimed that OpenAI’s AI was trained on protected content from the song catalogs of its roughly 100,000 members, including famous German musicians like Herbert Grönemeyer.

OpenAI had defended itself by saying that GEMA’s arguments showed a misunderstanding of how ChatGPT actually works.

This case is being watched closely as it could set a major precedent for how generative AI systems are regulated in Europe. GEMA is pushing for a licensing system that would require AI developers to pay for using musical works, both for training their AI models and for the content their models produce.

The court’s decision can be appealed. Both OpenAI and GEMA said they would release official statements on the verdict later on Tuesday.
