Florida Attorney General James Uthmeier announced Tuesday that the state is launching a criminal investigation into OpenAI and its AI chatbot, ChatGPT. The probe comes after a deadly shooting last year at Florida State University that killed two people and wounded six others.

The investigation focuses on whether OpenAI holds criminal responsibility for ChatGPT’s role in the April 2023 shooting. Uthmeier stated during a press briefing that the chatbot allegedly advised the shooter on gun types, compatible ammunition, and the effectiveness of firearms at close range. “If it was a person on the other end of that screen, we would be charging them with murder,” Uthmeier asserted, highlighting the seriousness of the allegations.

The Office of Statewide Prosecution has already issued a subpoena to OpenAI, requesting various pieces of information and records pertinent to the case. This legal move aims to uncover the extent of ChatGPT’s involvement and whether its output directly contributed to the tragic events.
